Child-Resistant Cannabis Packaging

What Child-Resistant Actually Means

Child-resistant packaging is the most misunderstood term in cannabis retail. A producer will say "our bags are child-resistant" because they have a tricky zipper. That doesn't mean anything. Child-resistant is a regulatory designation, not a description. It means the closure mechanism has been tested under 16 CFR 1700.20, a protocol administered by the US Consumer Product Safety Commission.

The test is specific. A panel of children aged 42 to 51 months is given the package and told to open it. If 85% or more can't open it within 10 minutes, the package passes. Then a panel of adults aged 50 to 70 has to be able to open it within 5 minutes. If both tests pass, the closure is certified CR.

There's also ASTM D3475, which classifies CR packaging into types based on the mechanism. A push-and-turn cap is one type. A squeeze-and-pull is another. The type matters because some states specify which ASTM D3475 type they accept. If your state requires Type III and you bought Type I, you're not compliant even though the package is technically child-resistant.

What I tell producers is to ask for the certification document before you buy. A reputable manufacturer will hand you a test report from a CPSC-accepted lab. If the seller can't produce that document, walk away. We provide our certification for every CR product we make. It's not optional. It's the law.

Questions

Everything you need to know.

What's the difference between child-resistant and childproof?
Nothing is childproof. The term doesn't exist in regulation. Child-resistant means most young children can't open it, given enough time. Some kids will figure it out. The standard requires that 85% of a test group can't open it in 10 minutes. If someone tells you their packaging is childproof, they don't know the regulation.
How long is a CR certification valid?
The certification is tied to the specific closure design and material. As long as the manufacturer doesn't change the mechanism or the material, the certification stays valid. If the supplier changes the zipper supplier or the plastic resin, the certification may no longer apply. Ask for the date of the last test.
Can a mylar bag be child-resistant?
Yes, if the zipper closure has been tested and certified under 16 CFR 1700.20. Not all CR zippers pass. The test requires that children can't defeat the zipper within 10 minutes. We use certified CR zippers on our mylar bags and provide the test report with your order.
Do I need CR packaging if I sell at a medical dispensary only?
Most medical states still require CR packaging for take-home products. The rules vary. Some states require CR only for non-patient purchases, others require it for everything. Check your state's specific regulation. We can tell you what we've seen in your market.
