Welcome to CropPak. These Terms of Service ("Terms" or "Agreement") govern your use of croppak.com (the "Site") and the process of requesting packaging quotes, placing orders, and receiving custom-printed cannabis packaging products from CropPak ("we," "our," or "us").
By accessing our Site, submitting a quote request, or placing an order with us, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site or services. These Terms constitute a legally binding agreement between you and CropPak, located at Suite 51 - 31125 Westridge Place, Abbotsford, BC V2T 0B9, Canada.
1. Accuracy of Website Information and Regulatory Content
1.1 No Legal or Regulatory Advice
CropPak is a packaging manufacturer, not a law firm or regulatory advisory firm. Nothing on this website constitutes legal advice, regulatory advice, or a guarantee that any packaging product will comply with the laws of any jurisdiction. Any information provided on this Site regarding regulatory requirements, packaging standards, child-resistance specifications, labeling rules, or compliance with any law is provided for general informational purposes only and does not constitute legal or professional advice.
1.2 Regulatory Information May Be Out of Date or Incorrect
The cannabis packaging regulatory landscape is complex and constantly evolving. Federal, state, provincial, and municipal laws and regulations change frequently and without notice. We make every reasonable effort to keep the information on this website accurate and current, but we do not guarantee that any regulatory information on this Site is up to date, complete, or correct at the time you read it. Regulations cited on this Site may have been amended, repealed, superseded, or interpreted differently by courts or regulatory agencies since the content was written.
Information on this Site may reflect our understanding of regulations at the time of writing, which may be based on secondary sources, regulatory guidance documents, or industry interpretation. It may not reflect the most recent regulatory changes, enforcement priorities, or official interpretations.
1.3 You Are Solely Responsible for Compliance
It is your sole and exclusive responsibility to verify that your packaging complies with all applicable laws and regulations in every jurisdiction where your cannabis products will be sold, distributed, or consumed. You must not rely on any information provided on this Site as a substitute for obtaining your own legal or regulatory advice from qualified professionals.
Before ordering packaging from CropPak or placing any cannabis product on the market, you should:
- Consult with a qualified attorney licensed in your jurisdiction who specializes in cannabis regulatory compliance
- Review the current official regulatory text and guidance from the relevant regulatory authority (such as the Department of Cannabis Control in California, the Cannabis Compliance Board in Nevada, Health Canada, the CPSC, or any other applicable federal, state, or provincial agency)
- Obtain your own independent determination that your packaging meets all current requirements, including but not limited to child-resistance certification, opacity, labeling, universal symbols, health warning placement, and any other applicable standards
- Verify that any child-resistant packaging certification we provide is accepted by the regulatory authority in your jurisdiction, as certification standards and testing protocols may differ between jurisdictions and may be updated
1.4 No Reliance on Website Content
You acknowledge and agree that you will not rely on any regulatory or compliance information provided on this Site when making decisions about whether your packaging is legally compliant. CropPak shall not be liable for any damages, fines, penalties, product recalls, license suspensions, business losses, or any other consequences arising from your reliance on information contained on this Site.
If you become aware that any information on this Site is incorrect or out of date, we encourage you to notify us at info@croppak.com so we can review and update the content. However, CropPak has no obligation to update any content on this Site and assumes no duty to monitor regulatory changes or update previously published content.
1.5 State-Specific and Country-Specific Content
This Site contains pages describing cannabis packaging requirements for individual US states and for Canada. These pages are informational summaries, not official legal references. They do not reproduce the full text of any regulation and may omit requirements that apply to your specific product or situation. Some pages may describe regulations that have been amended or are no longer in effect. Some pages may contain errors or oversimplifications of complex regulatory requirements. Always consult the official, current regulatory text and a qualified attorney before making compliance decisions.
2. Use of the Website
2.1 Purpose of the Site
The CropPak website is a business-to-business (B2B) platform designed for licensed cannabis cultivators, processors, distributors, and retailers to request quotes for factory-direct cannabis packaging products. The Site allows you to browse our product catalog, submit quote requests with your specifications, and communicate with our team about your packaging needs.
2.2 Eligibility
Our Site and services are available only to individuals and entities who are at least 19 years of age (or the age of legal majority in their jurisdiction) and are engaged in a legitimate business related to cannabis cultivation, processing, distribution, or retail. By using our Site, you represent and warrant that you meet these eligibility requirements and are authorized to conduct business on behalf of any company you represent.
2.3 Acceptable Use
You agree to use our Site only for lawful purposes and in compliance with all applicable laws and regulations. You agree not to:
- Submit false, inaccurate, or misleading information in a quote request
- Use the Site for any fraudulent, illegal, or unauthorized purpose
- Attempt to gain unauthorized access to any part of the Site, our systems, or data
- Interfere with or disrupt the operation of the Site or servers
- Scrape, copy, or distribute content from the Site without our written permission
- Submit artwork, logos, or designs that infringe on the intellectual property rights of any third party
2.4 Account Registration
While browsing our product catalog does not require registration, submitting a quote request requires you to provide accurate contact and company information. You are responsible for maintaining the accuracy of the information you provide and for all activity that occurs under the contact details you submit.
3. Quote Requests and Pricing
3.1 Quote Requests Are Estimates
All quotes provided through our website or by our sales team are estimates only and do not constitute a binding contract or offer to sell. A quote represents our current best estimate of the cost to manufacture and deliver your requested packaging products based on the specifications you provide at the time of the request. Prices are subject to change based on material costs, order quantity adjustments, specification changes, and other factors.
3.2 Binding Agreement
A binding contract between you and CropPak is formed only when:
- You receive a formal quote or invoice from CropPak confirming the order details, pricing, and lead time
- You provide written confirmation (by email or signed purchase order) accepting the quote
- We acknowledge receipt of your confirmation and provide an order confirmation
No order is considered placed, accepted, or binding until all three steps above are completed. Until that point, either party may modify or withdraw a quote without obligation.
3.3 All-Inclusive Pricing
CropPak provides all-inclusive pricing on confirmed orders. Unless otherwise stated in your formal quote, our prices include:
- Packaging product manufacturing
- Custom printing and decoration
- Shipping to your provided address
- Applicable duties and customs fees for shipments between Canada and the United States
We do not charge hidden fees. The price on your confirmed quote is the price you pay. Applicable taxes (GST, PST, HST, or sales tax) will be clearly itemized on your invoice and are not included in the all-inclusive product price unless explicitly stated.
3.4 Price Validity
Quotes are valid for 30 days from the date issued unless otherwise specified. After 30 days, pricing is subject to review and may be adjusted based on current material and production costs. We will honor the quoted price for any order confirmed within the validity period.
4. Order Minimums and Lead Times
4.1 Minimum Order Quantities
Most CropPak products have minimum order quantities (MOQs) that vary by product type and customization level. Minimum order quantities will be clearly stated on your formal quote. We may, at our discretion, accept orders below the standard MOQ with a small-order surcharge.
4.2 Production Lead Times
Standard production lead times are provided on each formal quote and vary based on product type, order quantity, and level of custom printing. Typical lead times are:
- Stock (unprinted) products: 5 to 10 business days from order confirmation
- Custom-printed products: 15 to 25 business days from artwork approval
- Custom-molded or specialty products: 4 to 8 weeks from mold or design approval
Lead times are estimates and begin from the date of artwork or design approval, not from the date of order confirmation. Production timelines may be affected by material availability, manufacturing schedules, and shipping logistics. We will communicate any significant delays as soon as they are known.
4.3 Shipping
CropPak ships to addresses in Canada and the United States. Shipping is included in our all-inclusive pricing. Delivery times after production are typically 2 to 7 business days within Canada and 5 to 10 business days to the United States, depending on destination. We are not responsible for shipping delays caused by carriers, customs, weather, or other factors outside our control.
5. Cannabis Packaging Compliance
5.1 Customer Responsibility for Compliance
CropPak manufactures packaging products to the specifications provided by the customer. It is the customer's sole responsibility to verify that their packaging complies with all applicable laws and regulations in the jurisdictions where their cannabis products will be sold, distributed, or consumed. CropPak does not provide legal or regulatory advice and does not warrant that any specific packaging product will satisfy the requirements of any particular jurisdiction.
The information on this Site about state, federal, and international cannabis packaging requirements is provided for general reference only. As stated in Section 1, this information may be out of date, incomplete, or incorrect. The customer bears all risk and responsibility for verifying compliance with current applicable regulations.
5.2 United States Regulatory Requirements
Customers distributing cannabis products in the United States are responsible for ensuring their packaging meets all applicable federal and state requirements, including but not limited to:
- 16 CFR 1700.20 - The Poison Prevention Packaging Act, which requires child-resistant packaging for certain products. CropPak can manufacture child-resistant packaging upon request, but the customer must verify that the specific packaging design meets the testing and certification requirements of this regulation
- State cannabis packaging regulations - Each state with legal cannabis has its own packaging requirements, which may include child-resistance certification, opaque packaging, universal warning symbols, THC content labels, government warning statements, and specific label formatting. State regulations change frequently. The customer is responsible for verifying and meeting the current requirements of each state in which they operate
- ASTM D3475 - Standard classification for child-resistant packaging, where applicable
- FDA and other federal requirements - Depending on the product type, additional federal requirements may apply
5.3 Canadian Regulatory Requirements
Customers distributing cannabis products in Canada are responsible for ensuring their packaging meets all applicable requirements under the Cannabis Act and regulations administered by Health Canada, including but not limited to:
- Child-resistant packaging requirements as specified in the Cannabis Regulations
- Prohibited promotional elements on packaging (e.g., no lifestyle branding, no depictions of persons, no testimonials or endorsements)
- Mandatory labeling information (THC/CBD content, health warning messages, producer information, etc.)
- Plain packaging requirements as applicable to the product category
- The standardized cannabis symbol requirements
- Any provincial or territorial requirements that supplement federal regulations
5.4 Compliance Certification
Where CropPak offers child-resistant packaging, we may provide test data or certification from third-party testing laboratories. However, the customer remains responsible for ensuring that the complete packaging system (container, closure, and any secondary packaging) meets the child-resistance requirements of their jurisdiction. CropPak's manufacturing of a product does not constitute a representation or warranty that the product is certified or compliant with any specific regulation.
5.5 Indemnification for Non-Compliance
The customer agrees to indemnify, defend, and hold harmless CropPak from any claims, fines, penalties, damages, or liabilities arising from the customer's use of CropPak packaging products in a manner that does not comply with applicable laws or regulations. This includes claims arising from packaging that does not meet child-resistance, labeling, or other regulatory requirements in the customer's jurisdiction.
6. Custom Printing and Artwork
6.1 Artwork Submission
When you request custom-printed packaging, you may submit artwork, logos, designs, or other materials (collectively, "Artwork") to CropPak for reproduction on your packaging products. You may submit Artwork electronically via email, file transfer service, or through our website.
6.2 Customer Warranty of Artwork Rights
By submitting Artwork to CropPak, you represent and warrant that:
- You own the Artwork or have obtained all necessary licenses, permissions, and rights to use the Artwork for the purpose of printing it on packaging
- The Artwork does not infringe on the copyright, trademark, trade dress, patent, or any other intellectual property right of any third party
- The Artwork does not contain defamatory, libelous, obscene, or otherwise unlawful content
- The Artwork does not violate any applicable law, regulation, or industry code, including cannabis advertising and promotion restrictions
- You have the authority to grant CropPak the right to reproduce the Artwork on your packaging
6.3 Indemnification for Artwork
You agree to indemnify, defend, and hold harmless CropPak, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to any breach of the warranties in Section 6.2, including any claim that your Artwork infringes the intellectual property rights of a third party.
6.4 Artwork Approval Process
Before production begins, CropPak will provide a digital proof of your Artwork as it will appear on the packaging. You must review and approve this proof in writing (by email) before production proceeds. Once you approve the proof, CropPak is not responsible for errors in the printed Artwork that were present in the approved proof, including typos, color variations, or layout issues. Color matching between digital proofs and printed products may vary slightly due to differences between screen display and physical printing processes.
6.5 Artwork Files
You are responsible for providing Artwork files in the format and resolution specified by CropPak. We recommend vector formats (AI, EPS, PDF) for logos and line art, and high-resolution raster images (300 DPI minimum) for photographic elements. CropPak may reject Artwork files that do not meet technical requirements and may charge a design fee for file preparation or modifications.
7. Returns and Refunds
7.1 Custom-Printed Items
Because custom-printed packaging is manufactured to your specific specifications with your Artwork, all custom-printed items are non-returnable and non-refundable except in cases of manufacturing defects or errors on the part of CropPak. This policy applies because custom-printed products cannot be resold to other customers.
7.2 Defective or Non-Conforming Products
If you receive custom-printed products that contain manufacturing defects or do not conform to the approved proof or order specifications, you may request a replacement or refund. To be eligible for a return due to defects:
- You must notify CropPak in writing at info@croppak.com within 10 business days of receiving the order
- You must provide photographic evidence of the defect or non-conformity
- The defect must be a manufacturing or printing error, not a result of artwork approved by you (see Section 6.4) or damage occurring after delivery
Upon verification of a valid defect claim, CropPak will, at our option, either reprint and replace the defective products at no charge or issue a refund for the defective portion of the order.
7.3 Stock (Unprinted) Products
Unprinted stock products may be returned within 14 days of delivery, provided they are in their original condition and packaging. The customer is responsible for return shipping costs. A restocking fee of 15% may apply. To initiate a return of stock products, contact info@croppak.com with your order number and reason for return.
7.4 Damaged in Transit
If your order arrives damaged in transit, please contact us at info@croppak.com within 48 hours of delivery and provide photographs of the damaged items and packaging. We will file a claim with the carrier and arrange for replacement of the damaged items at no cost to you.
7.5 Order Cancellation
Orders may be cancelled without penalty if cancellation is requested before production begins. Once production has started on custom-printed items, the order cannot be cancelled and is non-refundable, as materials have been allocated and manufacturing costs incurred. To cancel an order, contact us immediately at info@croppak.com.
8. Payment Terms
8.1 Payment Methods
CropPak accepts payment by credit card (Visa, Mastercard, American Express), electronic funds transfer (EFT), and wire transfer. Payment terms for established customers (e.g., net 30) may be available upon credit approval.
8.2 Payment Schedule
For first-time orders and orders under a certain value threshold (as determined by CropPak), full payment is required before production begins. For established customers with approved credit terms, a deposit may be required with the balance due per agreed-upon terms. Specific payment terms will be stated on your formal quote and invoice.
8.3 Late Payments
Payments not received by the due date stated on your invoice may be subject to a late payment charge of 1.5% per month (18% annually) on the outstanding balance. CropPak reserves the right to suspend production or withhold shipment on orders with overdue balances.
9. Intellectual Property
9.1 Website Content
All content on the CropPak website, including but not limited to text, graphics, logos, images, product designs, photographs, software, and the overall look and feel of the Site, is the property of CropPak and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from our Site without our prior written consent.
9.2 Trademarks
The CropPak name, logo, and all related marks are trademarks of CropPak. All other trademarks, service marks, and trade names appearing on our Site are the property of their respective owners. Nothing on our Site grants any license or right to use any trademark without the owner's prior written consent.
9.3 Customer Artwork Ownership
As between you and CropPak, you retain all ownership rights in the Artwork you submit for custom printing. CropPak does not claim ownership of your Artwork. We are granted a limited, non-exclusive license to use, reproduce, and display your Artwork solely for the purpose of manufacturing your packaging products and providing proofs for your approval.
9.4 Product Designs
Product designs, mold designs, and packaging configurations developed by CropPak remain the intellectual property of CropPak. Custom tooling or molds created specifically for a customer's unique product may be subject to separate tooling agreements that address ownership and usage rights.
10. Disclaimers
10.1 No Warranties
Except as expressly stated in these Terms or in a written warranty provided with a specific product, all products and services provided by CropPak are offered "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. CropPak does not warrant that any product will meet the regulatory requirements of any specific jurisdiction or that the website will be uninterrupted, error-free, or free of harmful components.
10.2 No Regulatory Advice and No Guarantee of Accuracy
CropPak is a packaging manufacturer, not a legal or regulatory advisory firm. Any information provided by CropPak regarding regulatory requirements, packaging standards, or compliance, whether on this website, in email communications, in quotes, or verbally, is for general informational purposes only and does not constitute legal advice. We do not guarantee the accuracy, completeness, or currency of any regulatory information we provide. Customers should consult with qualified legal counsel or regulatory compliance experts to ensure their packaging meets all applicable requirements.
As further described in Section 1, cannabis regulations at the federal, state, and provincial levels change frequently. Information that was accurate when written may no longer be accurate when you read it. You bear the full responsibility for verifying compliance with all current applicable laws and regulations.
10.3 Product Samples
Product samples provided by CropPak are intended to demonstrate general product characteristics and may not exactly represent the final production run. Variations in color, material, finish, and dimensions may occur between samples and production batches. The approved production proof (Section 6.4) is the controlling reference for the final product.
11. Limitation of Liability
To the maximum extent permitted by applicable law, CropPak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Site, your order, or the products we manufacture. CropPak's total aggregate liability for any claim arising from or related to these Terms or your order shall not exceed the amount you paid to CropPak for the specific product(s) that are the subject of the claim.
This limitation of liability applies regardless of the legal theory pursued, whether in contract, tort (including negligence), strict liability, or otherwise, and even if CropPak has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.
Specifically, and without limitation, CropPak shall not be liable for any damages or losses arising from:
- The customer's use of packaging that does not comply with applicable laws or regulations in their jurisdiction
- The customer's reliance on any regulatory or compliance information published on this website, which may be out of date or incorrect
- The customer's failure to verify that packaging meets child-resistance, labeling, or other regulatory requirements

12. Indemnification
You agree to indemnify, defend, and hold harmless CropPak, its officers, directors, employees, agents, suppliers, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Site or violation of these Terms
- Your breach of any representation or warranty in these Terms, including the artwork warranties in Section 6.2
- Your use of CropPak packaging products in a manner that violates any applicable law or regulation
- Your reliance on regulatory information published on this Site that was out of date, incorrect, or incomplete
- Your failure to independently verify that your packaging complies with all applicable laws and regulations

13. Confidentiality
CropPak respects the confidentiality of your business information. We will not disclose your order details, product specifications, or Artwork to third parties without your consent, except as necessary to fulfill your order (e.g., sharing specifications with our manufacturing partners) or as required by law. Both parties agree to maintain the confidentiality of any pricing, product development, or business information shared during the course of their business relationship.
14. Force Majeure
CropPak shall not be liable for any delay or failure to perform our obligations under these Terms when such delay or failure is caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics or public health emergencies, government actions or regulations, material shortages, manufacturing equipment failures, labor disputes, transportation disruptions, customs delays, or other force majeure events. In such circumstances, we will use commercially reasonable efforts to resume performance as soon as practicable and will communicate with you regarding expected timelines.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms and any dispute arising from or related to them, your use of the Site, or your order with CropPak shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
15.2 Jurisdiction
You agree that any legal action or proceeding arising from or related to these Terms or your order shall be brought exclusively in the courts of the Province of British Columbia, Canada, and you consent to the exclusive jurisdiction and venue of such courts. You waive any objection to venue or inconvenient forum in these courts.
15.3 Dispute Resolution Process
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, the parties may pursue mediation before initiating litigation. This section does not prevent either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
16. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our business practices, products, legal requirements, or other factors. The "Effective Date" at the top of this document indicates when the Terms were last revised. Changes are effective immediately upon posting the updated Terms on our Site. We encourage you to review these Terms periodically. Your continued use of our Site after changes are posted constitutes acceptance of the updated Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. The remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with any formal quote, invoice, or other written agreement signed by both parties, constitute the entire agreement between you and CropPak regarding your use of the Site and your orders. These Terms supersede any prior agreements, communications, or understandings, whether written or oral. No modification of these Terms is binding unless in writing and signed by an authorized representative of CropPak.
19. Assignment
You may not assign or transfer these Terms or any rights or obligations under them to any third party without the prior written consent of CropPak. CropPak may assign these Terms to a successor in connection with a merger, acquisition, or sale of all or substantially all of its assets without prior consent.
20. Waiver
No failure or delay by CropPak in exercising any right under these Terms shall constitute a waiver of that right. A waiver on one occasion shall not be construed as a waiver of any right on future occasions.
